1. Agreement
By using the BidDesk website or subscribing to its digest you agree to these Terms and our Privacy Policy. If you do not agree, do not use BidDesk. You must be 18+ and using BidDesk for business purposes.
2. The service
BidDesk sends email digests of U.S. federal contracting opportunities and contract records matched to the states and industry codes you choose. Data comes from public government sources (see the Data-Source Disclaimer, which is part of these Terms).
3. No guarantee; not advice
BidDesk is an information service. We do not guarantee that any listing is complete, current or accurate, that you are eligible for any opportunity, or that you will win any contract. Nothing we send is legal, procurement, accounting or tax advice. Always check the official notice on SAM.gov and follow the solicitation's instructions and deadlines.
4. Not affiliated with the government
BidDesk is not affiliated with, endorsed by, or acting for the U.S. government, SAM.gov, GSA, USAspending.gov or any agency.
5. Acceptable use
You agree not to: resell, redistribute or republish the digest in bulk without written permission; use digest content to send unsolicited email or build marketing lists; scrape or overload the site; or use BidDesk unlawfully.
6. Intellectual property
The underlying government data is public. Our selection, scoring, formatting and site content are owned by BidDesk. Some award records may include third-party data that carries its own attribution or restrictions (see the Data-Source Disclaimer).
7. Disclaimer of warranties
BIDDESK IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BidDesk IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS OR LOST CONTRACTS, AND ITS TOTAL LIABILITY IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR $100.
9. Termination
You may unsubscribe at any time. We may suspend or end the service, or your access, at any time.
10. Changes
We may update these Terms; we will post the new version with a new effective date and email subscribers about material changes.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, and disputes go to the courts of Lehigh County, Pennsylvania.
